• loss of opportunity;

To the maximum extent permitted by applicable law, where a liability cap is legally permissible, OLNIN's aggregate liability relating to a particular Service may be limited to the amount actually paid for that specific Service giving rise to the claim, unless a different limit is expressly stated in a signed or electronically accepted Agreement.

Nothing in this Legal Package excludes or limits liability that cannot lawfully be excluded or limited.

PART 24 — INDEMNIFICATION

110. Customer Indemnification

To the maximum extent permitted by applicable law, the Customer agrees to indemnify and hold harmless OLNIN and its directors, officers, employees, representatives, contractors and authorized personnel from claims, losses, liabilities, damages, costs and expenses arising from:

• breach of applicable terms;
• unlawful conduct;
• misuse of facilities;
• property damage;
• unauthorized activity;
• infringement of third-party rights;
• Customer-generated material;
• Guest conduct;
• Customer vendors;
• or violation of applicable law, to the extent legally recoverable.

111. Event Indemnification

Where applicable, an Event Organizer may be responsible for claims arising from:

• attendees;
• vendors;
• entertainers;
• equipment;
• décor;
• catering;
• unauthorized activities;
• or event-related damage, subject to applicable law and the Event Agreement.

PART 25 — INSURANCE

112. Customer Insurance

Customers should maintain appropriate insurance for relevant risks, including:

• business property;
• equipment;
• employees;
• Guests;
• events;
• public liability;
• professional risks;
• and other relevant risks.

113. Event Insurance

OLNIN may require evidence of appropriate insurance for particular events or activities.

PART 32 — FORCE MAJEURE

136. Force Majeure

OLNIN is not responsible for failure, delay, interruption or modification caused by circumstances beyond reasonable control, including:

• natural disasters;
• extreme weather;
• fire;
• flood;
• epidemic or pandemic;
• war;
• terrorism;
• civil unrest;
• government action;
• regulatory restrictions;
• strikes;
• utility failures;
• telecommunications failures;
• cyber incidents;
• building damage;
• supplier failures;
• transportation disruption;
• or other extraordinary circumstances.

137. Remedies

Where appropriate, OLNIN may:

• suspend Services;
• modify Services;
• relocate activities;
• postpone events;
• provide alternative dates;
• provide credits where appropriate;
• or terminate affected arrangements, subject to the applicable Agreement and law.

PART 50 — MAXIMUM LEGALLY PERMITTED PROTECTION

172. Protection of OLNIN

This Legal Package is intended to protect OLNIN's legitimate:

• commercial interests;
• financial interests;
• operational interests;
• intellectual property;
• confidential information;
• security;
• privacy;
• property;
• and reputation to the maximum extent permitted by applicable law.

Nothing in this Legal Package is intended to:

• eliminate liability that cannot legally be eliminated;
• remove mandatory statutory rights;
• misrepresent consumer rights;
• prevent lawful regulatory action;
• or contract out of non-excludable obligations.
